1. Application of Conditions
In these Terms and Conditions, “We”, “Us” and “Our” refer to Kingswood Joinery UK LTD. The terms “You”, “Yourselves”, “The Customer” and “The Client” refer to the purchaser of goods or the user/viewer of our website.
You should read these Terms and Conditions in conjunction with our Maintenance Manual and Warranty Guidelines.
Our Terms & Conditions are provided in advance with quotations, and placing an order or paying a deposit confirms acceptance.
By placing an order with us, you are agreeing to these Terms & Conditions.
2. Quotations
Any quotation given by us is valid for the period stated on the quotation. After this period, we will produce a new quotation in accordance with the prevailing price file, and any discounts may be removed.
It is your responsibility to ensure the accuracy of the items described in the quotation and to inform us in writing of any amendments required. Any amendments may result in a change of price.
Our quotations are an interpretation of your requirements. Upon finalisation of specific details, the price may change.
Our quotations are valid for 30 days from the date of issue. After this period, we reserve the right to amend the price, and a new quotation will be issued in writing. This is due to ever-increasing energy and material costs.
Any verbal agreements between an employee of Kingswood Joinery UK LTD and the Customer shall not form any part of the contract. If a verbal agreement is made, you must assume it is not included within the contract unless it is confirmed in writing by Head Office.
All variations, amendments or additional works requested by the Customer must be confirmed and approved in writing by Kingswood Joinery UK LTD before manufacture or additional works commence.
Approval of drawings, specifications, ironmongery selections, glazing configurations, paint finishes or any bespoke details confirms acceptance of all associated costs and manufacturing requirements.
Any changes requested after approval may result in additional charges, manufacturing delays and revised installation dates.
Verbal instructions, discussions on site or informal communications shall not constitute approved variations unless confirmed in writing by Head Office.
If an order value increases after a quotation has been issued, Kingswood Joinery UK LTD reserves the right to request an additional deposit to bring the total deposit paid to 50% of the revised order value.
3. Survey
3. Survey
Any survey carried out by Kingswood Joinery UK LTD is not a full structural survey of the property and relates only to the installation of the windows and/or doors. It will be assumed that the property is structurally sound and that there are no unknown factors that would affect our ability to complete the installation or increase the difficulty of the works.
Our surveys are non-destructive; therefore, we cannot fully guarantee the accuracy of our surveys, nor can they be relied upon as a method of identifying or preventing all unexpected issues that may arise during installation.
Should you have any concerns regarding the structural condition of your property, we recommend obtaining an independent survey from a qualified third party.
Kingswood Joinery UK LTD reserves the right to remove render, plaster, architraves, beading and linings at the time of survey in order to establish accurate manufacturing dimensions. Any damage caused during this process, excluding decorative finishes, will be made good upon installation.
All site surveys carried out are chargeable at the discretionary rate determined by Kingswood Joinery UK LTD. Survey fees are payable in advance and are non-refundable once the survey has taken place, as they cover professional time and costs already incurred.
A technical site survey and measuring fee of £150 + VAT is payable in advance prior to attendance. This fee covers professional measuring, specification assessment, quotation verification, travel and administrative costs.
Where the Customer proceeds with an order, the survey fee will be deducted from the final contract balance.
Survey fees are non-refundable once site attendance has taken place.
If issues are discovered that increase the cost of works or require changes to the specification of the quoted goods, Kingswood Joinery UK LTD reserves the right to adjust the quotation, postpone the order or cancel the order accordingly.
Following the survey, you will receive specification details and drawings of each item ordered. You are responsible for reviewing and approving these details before manufacture commences. Any changes requested after approval may result in additional charges.
4. Confidentiality
In the event of an order, you may receive confidential or commercially sensitive information. You agree to treat such information as confidential and not disclose or use it for any purpose other than fulfilling your obligations as the purchaser of goods and services supplied by Kingswood Joinery UK LTD.
5. Delivery & Installation
All installation dates, delivery dates and timescales are provided in good faith and are accurate at the time they are given. Whilst Kingswood Joinery UK LTD aims to meet all agreed dates, delays may occasionally occur due to circumstances beyond our control.
Should dates change, we will notify you as soon as reasonably possible. Delays in delivery or installation shall not constitute grounds for withholding payment or requesting compensation or discounts.
Prior to our arrival, you are responsible for preparing all pathways and working areas surrounding the installation area. Suitable parking must be available as close to the property as reasonably possible to allow safe loading and unloading of tools and materials.
You are responsible for ensuring the work area is free from furniture, curtains, blinds, personal belongings or any other obstructions that may hinder safe working conditions.
Where our team moves items at their discretion, Kingswood Joinery UK LTD accepts no liability for damage or loss to those items.
If significant obstructions prevent works from proceeding, Kingswood Joinery UK LTD reserves the right to postpone installation and charge wasted day rates, including reasonable fuel costs.
It is your responsibility and at your own expense to arrange the removal, replacement or alteration of any fixtures, fittings or items that may obstruct installation, including but not limited to curtains, shutters, grilles, blinds, pelmets, carpets and soft furnishings.
Kingswood Joinery UK LTD is not responsible for repositioning furniture or re-hanging curtains or blinds following installation.
As all windows and doors are bespoke and manufactured specifically to order, postponement of an agreed installation date within 28 working days of the scheduled installation date may result in wasted day charges being applied per installer, per day lost.
Any wasted day charges, aborted visits, additional attendance costs or delays caused directly or indirectly by the Customer, third-party contractors or site conditions shall become immediately payable upon invoicing.
Kingswood Joinery UK LTD reserves the right to suspend manufacture, delivery or installation works until such charges have been settled in full.
If our fitting team is prevented from carrying out installation due to the Customer’s actions or omissions, including but not limited to non-payment, lack of access or unsafe working conditions, Kingswood Joinery UK LTD reserves the right to remove staff from site and postpone installation.
Any lost time shall be chargeable at the wasted day rate and must be settled prior to further attendance.
Our fitting team is not permitted under the terms of our insurance to reposition electrical, alarm, gas or water installations.
Any abusive, threatening or aggressive behaviour towards our staff, whether on site or within the office, will not be tolerated. Kingswood Joinery UK LTD reserves the right to cancel the contract immediately in such circumstances. Any outstanding balance shall become immediately payable, and goods may be delivered without installation.
Our fitting team will leave work areas as clean and tidy as reasonably possible. However, dust may remain airborne for several days following installation works.
For health and safety reasons, staff are not required to remove footwear whilst attending site. Protective overshoes may be worn where appropriate.
Any request made by the Customer which staff reasonably believe compromises health and safety may be refused.
Risk of damage to or loss of purchased goods passes to the Customer upon delivery to the property.
Ownership of all goods remains with Kingswood Joinery UK LTD until payment has been received in full.
6. Specification
Kingswood Joinery UK LTD will not redecorate existing windows or doors unless timber has become exposed as a direct result of our works, in which case exposed timber will be primed only.
Existing frames will not be painted other than staff beads or parting beads unless otherwise agreed in writing.
Dual-colour paint finishes and natural finishes are subject to additional charges.
All ironmongery, finishes and design selections are subject to Customer approval prior to manufacture.
Ironmongery supplied from Kingswood Joinery UK LTD’s standard collections is included unless otherwise stated. Any third-party or upgraded ironmongery shall incur additional charges.
Any upgraded ironmongery, specialist finishes, non-standard glazing, bespoke mouldings or alternative products requested outside Kingswood Joinery UK LTD’s standard specification range shall incur additional charges unless confirmed otherwise in writing.
All bespoke products are manufactured specifically to the Customer’s approved specification and are therefore non-returnable and non-refundable once manufacture has commenced.
Timber is a natural material, and variations in grain, texture, colour and movement shall not constitute defects.
Kingswood Joinery UK LTD reserves the right to decline fitting any sash where the existing weight cavity is insufficient.
Due to the age and condition of some properties, we cannot guarantee against damage to surrounding plaster, render or brickwork caused directly by installation works. Any making good shall be completed to a pre-decoration standard only.
Customers are responsible for ensuring their property is structurally sound and suitable for installation works.
Kingswood Joinery UK LTD cannot guarantee that existing shutters, blinds, curtains or ironmongery will fit following installation of new products.
We cannot guarantee that existing panes of glass removed during works will remain intact.
Any glazing supplied shall comply with Glass and Glazing Federation standards.
It is the Customer’s responsibility to obtain all necessary permissions, including planning permission, building regulations approval, listed building consent and conservation approvals where required.
Any advice given by Kingswood Joinery UK LTD regarding permissions shall be treated as guidance only.
Where manufacture proceeds prior to permissions being obtained at the Customer’s request, the full contract balance remains payable regardless of the outcome of any application.
Kingswood Joinery UK LTD reserves the right to amend product specifications where necessary due to material shortages, manufacturing improvements or legal/regulatory requirements.
Kingswood Joinery UK LTD reserves the right to use subcontractors or third-party suppliers where necessary to fulfil contractual obligations.
Warranties and guarantees, excluding statutory rights under the Consumer Rights Act 2015, shall only become valid once full payment has been received.
The Customer must inspect goods within 48 hours of delivery or installation and notify Kingswood Joinery UK LTD in writing of any visible issues, shortages or defects. Failure to do so shall constitute acceptance of the goods as delivered in respect of any visible defects or issues that would reasonably have been identifiable upon inspection.
Nothing within this clause shall limit or exclude any statutory rights afforded to Consumers under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.
7. Access
The Customer agrees to provide Kingswood Joinery UK LTD with reasonable access to the property for delivery and installation works.
If access cannot be provided within 7 working days of notification that goods are ready, the remaining contract balance may become immediately payable.
Kingswood Joinery UK LTD reserves the right to recover reasonable storage costs, losses and associated expenses resulting from delayed access.
Suitable parking and any required permits must be arranged by the Customer prior to attendance. Any parking charges, permits or congestion charges incurred may be added to the final invoice.
If scaffolding is deemed necessary, the Customer shall be responsible for arranging and paying for scaffolding unless otherwise agreed in writing.
The scaffolding contract shall remain solely between the Customer and the scaffolding supplier.
Failure to arrange required scaffolding may result in installation cancellation and wasted day charges being applied.
Any temporary access equipment hired directly by Kingswood Joinery UK LTD shall be chargeable to the Customer.
8. Wasted Days
If our installation team is unable to carry out works due to the Customer’s actions or omissions, including but not limited to non-payment, restricted access, unsafe conditions or delays caused by third parties, Kingswood Joinery UK LTD reserves the right to suspend works and leave site.
Any such delay shall be chargeable at a wasted day rate of £520 + VAT per installer, per day, plus reasonable fuel costs and any direct losses incurred. These charges represent a genuine and reasonable pre-estimate of the losses, labour costs, scheduling disruption and associated expenses likely to be incurred by Kingswood Joinery UK LTD as a result of aborted visits, postponed works or installation delays.
These charges must be paid before further installation dates are arranged.
Where delays prevent Kingswood Joinery UK LTD from reallocating installers to alternative works, wasted day charges may apply for the full originally scheduled installation period.
9. Liability
Kingswood Joinery UK LTD’s total liability shall not exceed the total contract value paid for the goods and services supplied, except where prohibited by law.
Kingswood Joinery UK LTD shall not be liable for losses arising from delays, manufacturing lead times, third-party contractors, structural defects, site conditions, planning restrictions or circumstances beyond our reasonable control.
We shall not be liable for indirect or consequential losses, including but not limited to loss of profit, loss of business or loss of goodwill.
Nothing within these Terms & Conditions shall limit or exclude statutory rights afforded under the Consumer Rights Act 2015 or any other applicable consumer legislation.
Where additional works or remedial attendance are required due to pre-existing defects, structural movement, damp, hidden defects, third-party interference or Customer-supplied specifications, Kingswood Joinery UK LTD reserves the right to charge for associated labour, materials and attendance costs.
10. Your Obligations
The Customer agrees, at their own expense, to:
- Comply with all reasonable requests made by Kingswood Joinery UK LTD or subcontractors relating to health and safety or installation requirements.
- Ensure all products are stored correctly in dry conditions to prevent damage, twisting or warping.
- Ensure the property remains structurally sound and suitable for installation works.
- Provide suitable parking, scaffolding and unobstructed access where required.
- Inform Kingswood Joinery UK LTD of any site-specific health and safety rules or security requirements.
- Obtain and maintain all required permissions, licences and consents relating to the works.
11. Your Privacy
Unless otherwise requested in writing prior to installation, Kingswood Joinery UK LTD may use photographs or videos of completed installations for advertising, portfolio, brochure, website and social media purposes.
No personal information, street names, house numbers, vehicle registrations or images of occupants shall knowingly be published without consent.
All Customer information shall otherwise remain confidential and handled in accordance with applicable data protection legislation.

Please provide your order reference number together with full details of the issue so that we may investigate and respond appropriately.
13. Third party orders and installations
Any products supplied by Kingswood Joinery UK LTD and subsequently sold on, altered or installed by a contractor not approved by us shall void all warranties and guarantees.
Kingswood Joinery UK LTD accepts no liability for third-party installation works or alterations carried out after supply.
14. Maintenance
To maintain warranty validity, all products supplied by Kingswood Joinery UK LTD must be maintained in accordance with our Maintenance Guidelines.
This includes regular cleaning, lubrication of moving parts and periodic redecoration where required.
Annual maintenance is recommended for standard environments, with more frequent maintenance advised for coastal or high-exposure properties.
Kingswood Joinery UK LTD reserves the right to request reasonable evidence of maintenance when assessing warranty claims.
Failure to maintain products correctly may limit or void warranty coverage.
Where remedial attendance is requested and no manufacturing or installation defect is identified, Kingswood Joinery UK LTD reserves the right to charge for labour, travel and associated costs.
Products exposed to excessive moisture, structural movement, poor ventilation, ongoing wet trades, third-party interference or improper storage conditions may be excluded from warranty coverage.
15. Payment Terms
A 50% deposit is required to secure all orders and commence manufacture.
No goods shall enter production until cleared funds have been received.
All payments must be made by bank transfer unless otherwise agreed in writing.
Deposits contribute towards administration, materials procurement, labour scheduling and bespoke manufacturing costs and therefore become non-refundable once manufacture or procurement has commenced.
Where installation is included, payment stages are as follows:
- 50% deposit payable upon order
- 45% installation payment payable 24 hours prior to installation or upon delivery to site
- 5% final balance payable immediately upon practical completion
Practical completion occurs once products are installed and functioning as intended, excluding minor snagging items.
Minor snagging items do not entitle the Customer to withhold payment.
No warranties, guarantees, future appointments, remedial works or warranty support shall become active until all outstanding balances have been settled in full.
Failure to make payment in accordance with these Terms & Conditions shall constitute a breach of contract.
Kingswood Joinery UK LTD reserves the right to:
- Suspend manufacture, delivery or installation
- Remove installers from site
- Withhold warranty activation
- Charge wasted day rates and associated costs
Where outstanding balances remain unpaid, Kingswood Joinery UK LTD reserves the right to instruct debt recovery agents and recover any applicable administration charges, interest, legal fees and recovery costs permitted by law.
16. Governing Law
These Terms & Conditions and any contract formed between Kingswood Joinery UK LTD and the Customer shall be governed by and construed in accordance with the laws of England and Wales.
Both parties agree that the courts of England and Wales shall have exclusive jurisdiction over any dispute or claim arising from the contract or its subject matter.
17. Severability
If any provision or part-provision of these Terms & Conditions is deemed invalid, unlawful or unenforceable by a court or competent authority, that provision shall, to the extent necessary, be deemed deleted.
Such deletion or modification shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
18. Consumer Rights
Nothing within these Terms & Conditions shall limit, exclude or affect any statutory rights afforded to Consumers under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013 or any other applicable consumer protection legislation.
Any limitation of liability, inspection period, warranty condition or payment obligation contained within these Terms & Conditions shall be interpreted subject to applicable consumer law.
Where the Customer is acting as a Consumer, statutory rights relating to satisfactory quality, fitness for purpose and services carried out with reasonable care and skill shall remain unaffected.
