1. Application of Conditions
In these Terms and Conditions “We” “Us” and “Our” refer to Kingswood Joinery UK LTD. The term ‘You’ ‘’Yourselves’’ “The Customer” and “The Client” refer to the purchaser of goods, or the user or viewer of our website.
You should read these Terms and Conditions in conjunction with our maintenance manual and warranty guidelines.
By placing an order with us you are agreeing to these terms and conditions.
2. Quotations
Any quotation given by us is valid for the period stated on the quotation. After this period, we will produce a new quotation in accordance with the prevailing price file and any discounts will be removed.
It is your responsibility to ensure the accuracy of the items described in the quotation and inform us of any amendments required in writing. Any amendments may result in a change of price.
Our quotations are an interpretation of your requirements; upon finalising of specific details the price may change.
Our quotations are valid for 30 days from the date of issue. After this period, we reserve the right to amend the price, and a new quotation will be issued in writing. This is due to the ever-increasing energy and material costs.
Any verbal agreements between an employee of Kingswood joinery UK LTD and you will not form any part of the contract. If a verbal agreement is made, you must assume it is not included in our contract until it is confirmed in writing by head office.
If an order value increases after we’ve issued your quotation you may be charged a second deposit to bring the deposit paid to 50% of the increased order value.
3. Survey
Any survey Kingswood joinery UK LTD carry out is not a full structural survey of your property and relates only to the installation of the windows and/or doors. The assumption will be made that your property is structurally ok and that there are no unknown factors that would affect our capability or increase the difficulty of an installation with our fitting team.
Our surveys are non-destructive therefore we cannot fully guarantee the accuracy of our surveys, and we cannot rely on them as method of removing unexpected issues that may arise during installation. Should you have any doubt regarding the structural condition of your property, we advise you to obtain your own independent survey carried out by a third party. Kingswood joinery UK LTD reserve the right to remove render, plaster, architraves, beading and linings at time of survey in order to establish correct manufacturing dimensions. Any damage that may occur during the survey process, this does not include decoration, will be made good upon installation.
All site surveys carried out are chargeable at the discretionary rate made by us. These rates will depend on the size and complexity of the project. Our surveys carried out prior to an order being placed will be credited back to the order, if and is not placed then the survey fee will not be refunded under any circumstances.
If we discover any issues that increase the cost or require a change to the specification of the quoted goods, we will inform you as soon as possible. In these circumstances or similar we reserve the right to cancel or postpone the order or to adjust the price accordingly.
After our survey you will receive details of each item you have ordered. You are responsible for approving the specification of these details and drawings, this confirmation and approval is required in order to proceed with the manufacture of your order. Changes to specification after approval may result in additional charges added.
5. Confidentiality
In the result of an order, you may receive confidential or market sensitive information. You will agree that you treat such information as confidential and will not directly or indirectly disclose this information or use it for any other purpose than to fulfil your obligations to Kingswood joinery UK LTD as the purchaser of goods and services you receive.
6. Delivery & Installation
All dates of installation, delivery of goods or timescales are given to you in good faith and are accurate at the time of the dates given. We aim to meet these dates but on rare occasions this may not always be possible therefore the dates may change at short notice. We will inform you of any changes to the scheduled dates at the earliest opportunity we can give you. If the dates are changed or installation is interrupted for any reason, Kingswood joinery UK LTD will not be held responsible for any losses incurred and will not be a satisfactory reason for withholding any payment and any delays in delivery will not justify any discount.
Prior to our arrival, you will be required to prepare the pathways leading to and areas surrounding the area our fitting will be working in. It will your responsibility to make sure our fitting team have adequate parking as close to the property as possible so that they can load and unload their tools and goods safely. It is your responsibility to make the area our team are working in free of furniture, curtains any personal belongings and any other items that could cause a trip hazard or obstruct our team from carrying out the installation in your property. If upon our arrival there are obstructing items then our team can move them for you at their own discretion, in this circumstance Kingswood joinery UK LTD will not accept any liability for loss or damage to the items that are moved. Many items (that would require a substantial amount of time to move) or any delicate items obstructing our installers from working and we reserve the right to re-arrange installation until the obstructions are cleared, should this happen this day will be charged to you at the wasted day rate per employee and any profits lost will also be chargeable including fuel costs.
It is your responsibility and will be at your own expense for the removal, replacement or alteration if required of any fixtures and fittings or other items that we require to be moved in order to install the goods and supply the services including but not limited to curtains, shutters, grilles, blinds, pelmets, and soft furnishings, the lifting and refitting of carpets. It is not our responsibility to re-position any furniture moved or re-hang any curtains or blinds that may have been moved during installation, but we will leave the area clean and tidy to the best of our ability.
Our windows and doors are bespoke and made solely to your specifications and manufacture is timed in accordance to installation dates agreed in advance. If you decide to postpone an agreed installation date less than 28 working days before the agreed installation date, we reserve the right to charge you at the wasted day rate per installer for every day of installation lost and in the event that no other suitable work can be found for the fitting team.
If our team are prevented from carrying out the installation by the client’s actions or non-actions, this includes but is not limited to, stage payment not being paid, not granted access, not clearing the work area suitable for our team to work safely; Kingswood joinery UK LTD reserve the right to remove our employees from your property and postpone the installation. You will be liable for incurring a charge for time lost through our fitting team attending your property and being unable to work at the wasted day rate. This must be paid prior to any further installation dates booked.
Our fitting team are not permitted under the terms of our insurance to reposition telephone or burglar alarm fittings or any other electrical connections, gas or water installations. If you do not comply with your obligations to organise this prior to installation we reserve the right to postpone or suspend the supply of our services until this is corrected. If our fitting team are unable to continue to carry out their work on another item you will be charged accordingly at the wasted day rate this will include any profits lost.
Any abuse to our staff in the office or on site will not be tolerated and we reserve the right to cancel your contract in the event that this occurs, you will be obligated to pay in full the outstanding balance immediately and we will deliver the goods to site without carrying out any installations.
Our fitting team will leave their work areas as tidy and clean as possible; however, dust will possibly stay in the air for several days after completion of the work which will eventually come to rest on the floor and on items. We will recommend that opening the windows and doors as often as possible to increase ventilation and cleaning as much as possible to reduce dust particles.
We take the health and safety of all staff seriously and for this reason members of staff will not be required to remove shoes when working or visiting your property. If this is a concern for you, they will be supplied with plastic shoe coverings.
Any request made from yourselves to our employees that they deem to infringe or put their health and safety at risk; they will have the right to decline this request and will inform Kingswood joinery UK LTD about this request.
Any risk of damage to or any loss of the purchased items shall pass over to you at the time of delivery of the purchased items to your property. It will be your responsibility to ensure the purchased items from the time they are delivered to your property. You are responsible for protecting the items from other trades who may also be on site.it will also be your responsibility to make sure your items are stored and stacked correctly to avoid any damages and/or twisting of timber. Kingswood joinery will not be responsible for this if this were to occur.
You will take ownership of the purchased items once we have received payment in full from you. Until then, all purchased items will remain the property of Kingswood joinery UK LTD but that will not prevent us from recovering payment from you of any amounts due and will then be passed onto a debt recovery agency.
7. Specification
Kingswood joinery UK LTD will not redecorate any existing doors or windows unless our work has caused any timber to become exposed, in which case we will cover the area with a coat of primer.
We will not paint over any existing frames other than the staff beads or parting beads unless specified this will be the responsibility of a professional painter arranged by you unless we have agreed other arrangements.
Two colour paint finishes will be subject to an extra charge per item. Natural finishes will also be subject to an extra charge per item. Charges for natural finishes are additional to charges for dual colour finishes.
All ironmongery, designs and specific finishes are subject to client approval before manufacture, application or fitting. All ironmongery supplied from our collections are included in our cost, any ironmongery that is sourced from a third party will be subject to an extra charge. Our doors only include ironmongery specified on the quotation. Any extra ironmongery from alternative suppliers can be sourced by us but will be subject to an extra charge.
We will reserve the right to decline fixing any sash if the weight cavity is not sufficient for both sets of new weights in an existing frame.
Due to the age of some properties, we cannot guarantee any damage that has resulted directly from our work such as damage to plaster, render or brickwork which immediately surrounds the item we have worked on but we will do our best to make good if this were to happen, but we do not accept liability for this and we will not redecorate the areas surrounding the item. The work will be completed to a pre-decorative standard. To avoid doubt, damaged plaster will be filled but will require sanding and painting, damaged render will be re-rendered but we will not apply any decorative patterns or pebble dash. We are not responsible for any blown plaster as this is a pre-existing issue.
You are responsible for ensuring that your property is structurally ok, in good condition and free from defects. Kingswood joinery UK LTD will not be held responsible for any damage caused or extra work required.
We cannot guarantee that existing shutters, blinds, curtains or ironmongery will still fit after the installation in new windows and doors. we will not be responsible for re-installing these items and will not be liable for any costs you may incur from sourcing and installing their replacements.
We cannot guarantee that any panes of glass from existing windows/doors will be remain intact during our services and we will not be liable for any damage or total loss of these items.
When re-glazing broken windowpanes, putty requires a minimum of one month to fully dry out. Unless prior agreement has been made, we do not paint putty for re-glazed panes. If we are manufacturing items that require putty glazing the putty will not be painted unless otherwise agreed.
Any glass supplied and installed by Kingswood joinery UK LTD will comply with the glass quality standards set out by the Glass and Glazing Federation and no other standards will apply.
It is your responsibility to obtain and maintain all necessary licences and consents including but not limited to building regulations consent, listed building consent, planning permissions in relation to the goods and services. Any advice given to you by Kingswood joinery UK LTD is only an opinion, and you should check if any planning is required using the appropriate channels. We will not be liable if any windows, doors or other items that are installed by us contravene any planning laws, conservation area rules or listed building regulations. It is the customer’s responsibility to ensure that the work we carry out is within regulations.
If Kingswood joinery UK LTD manufacture and supply the items ordered prior to you obtaining any of the necessary licences or consents the full balance must be payable upon completion even if the relevant licences and consents are subsequently not granted. We will only manufacture and supply your order prior to obtaining the necessary licences and consents if you make the request to do so in writing.
Following our survey, you will receive specification details and drawings of each item you have ordered. You are responsible for confirming and approving the specification of these details and drawings, this confirmation and approval is required in order to commence the manufacture of any windows and doors. Any changes you wish to make on the specifications after approval may be subject to an additional charge.
Due to progression in development any material shortages or to comply with relevant laws and regulations we reserve the right to modify and/or change product specification without prior notice.
We reserve the right to use sub-contracted labour in order to fulfil our order obligations, if this were the case you will be notified of this in writing. We also reserve the right to use third-party suppliers and products in order to fulfil any order obligations.
With the exception of any remedial work under the Consumer Rights Act 2015, any guarantee and warranties will only be valid and activate once the full outstanding payment has been received by Kingswood joinery UK LTD.
8. Access
You will agree to allow us to access your property to deliver the items ordered and to provide our services as soon as you have been advised that the items purchased are ready for delivery. If we cannot gain access to your property for this purpose within 7 working days of being informed that the goods are ready for delivery, then and without affecting any other rights we may have you will be required to pay the remaining outstanding balance of your order immediately. We will be entitled to recover any reasonable losses, costs and expenses from you that we incur as a result of your failure to take delivery of the items purchased including and without limitation any costs of storage of the items purchased.
It will be your responsibility to pay for and provide suitable parking and any required parking permits before work commences by our fitting team or delivery drivers. Failure to do so will result in any parking fees being added to the final invoice. It will be at our discretion as to whether congestion charges will also be added to the final invoice. Failure to supply suitable parking for our installers and delivery drivers may result in your order delivery being postponed and you may be charged at the wasted day rate, fuel costs and any profits lost.
If scaffolding is required in our opinion for the installation of the items purchased, we will inform you at the earliest opportunity following any of our site surveys. Our quotation will not include the cost of any scaffolding required to fulfil your order.
The contract for scaffolding will be between you and the third-party supplier and you will be solely responsible for payment to the supplier.
As the health and safety of our installers are a priority, the refusal to arrange scaffolding prior to our installation starting will result in Kingswood joinery UK LTD reserving the right to cancel your installation. In such circumstances we will deliver the items purchased to site without carrying out any installations. Any days on site where our installers have been unable to carry out any work due to lack of access will be chargeable at the wasted day rate including any fuel costs and profits lost.
Any access equipment, excluding fixed scaffolding, will be hired and supplied by Kingswood joinery UK LTD and any Hire costs will be added to your final invoice.
9. Wasted Days
If our fitting team are prevented from carrying an installation caused by the client’s actions or non-actions, including but not limited to, non-payment of the stage payment, not granting access, not clearing a suitable work area for the team; we reserve the right to remove our staff from your property and postpone the installation and will charge you for the time lost through our fitting team visiting your property and being unable to work at the wasted day rate of £520 +VAT per installer per day. This will be payable before any further installation dates are booked with us.
You will also be charged for any further days where we are unable to occupy our fitting team with any suitable work up to the number of days your project was scheduled for at the same wasted day rate
You will also be charged for the fuel costs and any profit lost by Kingswood joinery UK LTD.
10. Liability
If the performance of our obligations under the Contract is prevented or delayed by any act or omission of yours or your agents, subcontractors, consultants or employees, we shall not be liable for any costs, charges or losses sustained or incurred by you arising directly or indirectly from such prevention or delay.
We will not be liable to you for any pure economic loss, loss of profit, loss of business or depletion of goodwill whether direct or indirect, or for any loss or damage which was not reasonably foreseeable or contemplated by us at the date of the quotation.
11. Your Obligations
In order for us to perform our obligations and carry out the work, at your own expense:
Need to comply with reasonable requests made by us or subcontractors, relating to the supply of the items ordered, including but not limited to any requests relating to health and safety rules and regulations.
Need to make sure all windows and doors are stored correctly to avoid any warping or twisting of timber and be in a dry place, we will not take responsibility for any damages that were caused by yourselves or a third-party contractor.
Need to prepare and maintain your property in accordance with these terms and conditions for the delivery of the ordered goods and services. This includes making sure that the property is structurally ok, making sure that there is adequate parking available, making sure that scaffolding is in place where required, making sure that our installers have direct unobstructed access to the windows and doors at all times, making sure that there is adequate space for our installers to work in at all times, and ensuring that there is adequate indoor space to store the items purchased.
Need to Inform us of all health and safety rules and regulations and any other reasonable security requirements that apply to your property.
Need to Obtain and maintain all necessary licences and consents including but not limited to building regulations consent, listed building consent, planning permissions in relation to the goods and services. If Kingswood joinery UK LTD manufacture and supply the items purchased prior to you obtaining any of the necessary licences or consents, you will need to pay the full outstanding balance upon completion even if licences and consents are not granted. We will only manufacture and supply your order prior to obtaining the necessary licences and consents if you make the request to do so in writing.
12. Your Privacy
Unless you make the specific request for us not to, we may use photographs and videos of your property displaying the installed windows and doors that we have carried out in advertising material including our web site and social media platforms. All of your details including the specific location of your property will remain private.
13. Complaints
If you have a formal complaint relating regarding our product or service, please email office@kingswoodjoinery.com Please quote your purchase order reference number within your email and please provide us with as much detail as possible so that we can be better equipped to help resolving the issue.
14. Third party orders and installations
Any orders placed from Kingswood joinery UK LTD and sold on to a third party and/or installed by a contractor not approved by us will result in all warranties and guarantees being forfeit. Any complaints will not be accepted, and this will solely become your responsibility once the order has been purchased and paid in full. we will not take any responsibility there onwards.
15. Maintenance
It is your responsibility to ensure all maintenance and regular checks of the windows and doors purchased by us are done on a 6-month basis by a professional and up to our standard. All work will need to be carried out by a professional painter and decorator; all warranties and guarantees will become void failing to do so. proof of receipt from a registered company will be required for us to honour our warranties and guarantees. however, it will only be at our discretion to accept any maintenance done by yourselves and allow these warranties and guarantees to still be active. A full site survey will need to be booked and a charge for this service may be applied, this charge will be at our discretion. Please see our maintenance leaflet to ensure this has been carried out to our standard.
